APPLE INC. SAMPLE CODE LICENSE (for use with Apple Messages for Business)

PLEASE READ THIS SAMPLE CODE LICENSE (“AGREEMENT”) CAREFULLY BEFORE USING THE SAMPLE CODE.
BY USING THE SAMPLE CODE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT USE THE SAMPLE CODE.

IMPORTANT NOTE: THIS SAMPLE CODE IS LICENSED TO YOU FOR INTERNAL TESTING AND EVALUATION PURPOSES ONLY, AND IT SHOULD NOT BE USED IN A COMMERCIAL OPERATING ENVIRONMENT OR WITH IMPORTANT DATA.

License. Subject to the terms and conditions of this Agreement, you are granted a limited non-exclusive license under Apple’s copyrights in the sample code accompanying this license as originally provided by Apple (the “Sample Code”) to use, reproduce, and modify the Sample Code during the term of this Agreement solely for purposes of your own internal testing and evaluation of Apple Messages for Business; and only in accordance with the applicable terms of use for the Apple Messages for Business service. The Sample Code is not licensed under this Agreement for redistribution, sublicensing, or transfer of any kind. Except as expressly stated herein, no other rights or licenses are granted or to be implied, including but not limited to, any rights under Apple patents.
No Support and Maintenance. Apple is not obligated to provide any maintenance, support, or updates for the Sample Code. You acknowledge that Apple has no express or implied obligation to announce or make available a commercial, distributable version of the Sample Code to anyone in the future. Should a commercial, distributable version of the Sample Code be made available, it may not be compatible with the Sample Code licensed hereunder. Any development work you perform using the Sample Code will be at your sole expense and risk.
Term of Agreement. The term of this Agreement shall commence upon your downloading, installation or use of the Sample Code and will terminate automatically without notice from Apple if you fail to comply with any term(s) of this Agreement. Upon release of a new version of the Sample Code by Apple, You agree to cease using the Sample Code provided to You under this Agreement.
Disclaimer of Warranties.
A. The Sample Code provided hereunder is an internal version that may be incomplete and may contain inaccuracies or errors that could cause failures or loss of data.

B. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT, TO THE EXTENT PERMITTED BY APPLICABLE LAW, USE OF THE SAMPLE CODE AND ANY SERVICES ACCESSED THROUGH THE SAMPLE CODE, IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY, AND EFFORT IS WITH YOU.

C. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SAMPLE CODE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND APPLE AND APPLE’S LICENSORS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SAMPLE CODE, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS.

D. APPLE DOES NOT WARRANT THAT THE SAMPLE CODE WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE SAMPLE CODE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY SERVICES ACCESSED THROUGH THE SAMPLE CODE WILL CONTINUE TO BE MADE AVAILABLE, THAT THE SAMPLE CODE WILL BE COMPATIBLE WITH ANY OTHER PRODUCTS OR SERVICES, OR THAT DEFECTS IN THE SAMPLE CODE WILL BE CORRECTED.

E. YOU FURTHER ACKNOWLEDGE THAT THE SAMPLE CODE IS NOT INTENDED OR SUITABLE FOR USE IN SITUATIONS OR ENVIRONMENTS WHERE THE FAILURE OF, OR ERRORS OR INACCURACIES IN THE CONTENT, DATA, OR INFORMATION PROVIDED BY THE SAMPLE CODE COULD LEAD TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE, INCLUDING WITHOUT LIMITATION THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL, LIFE SUPPORT, OR WEAPONS SYSTEMS.

Limitation of Liability. IN NO EVENT SHALL APPLE BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) ARISING IN ANY WAY OUT OF THE USE, EVALUATION, TESTING, REPRODUCTION, MODIFICATION, AND/OR DISTRIBUTION OF THE SAMPLE CODE, HOWEVER CAUSED AND WHETHER UNDER THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF APPLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
